Today’s (7/31/23) Michigan Supreme Court Ruling Re: Andary v USAA Casualty Insurance Company (164772)

Hope Network – a leading statewide non-profit organization that provides healthcare and life services across Michigan, has released the following statement following today’s Michigan Supreme Court ruling in the case of Andary v USAA Casualty Insurance Company (164772). Hope Network is recognized as a leader in the brain injury community. Its Neuro Rehabilitation service line is made up of more than 150 experts specially trained in brain injury rehabilitation, delivering high-quality, targeted, cost-effective care to patients across Michigan.

On behalf of the 1,500 neuro rehabilitation patients we serve annually, Hope Network is pleased that the Michigan Supreme Court upheld the decision in Andary vs. USAA Casualty Insurance Company, ultimately upholding the private contracts that Michigan citizens had purchased from their auto insurance prior to June 11, 2019. Those contracts guaranteed that injuries would be covered for all necessary care, and the Supreme Court confirmed this obligation for policies issued and vested before the legislative changes occurred in June, 2019.

This was the right decision. An insurance policy is a contract for coverage should the worst happen, and it should not be able to be altered after the injury has occurred.
